In another blow to Trump, judge rules in favor of ACLU in family separation case

In a legal blow to the Trump administration, a federal judge ruled Friday that all migrant families separated during the government’s border crackdown should be included in a class-action lawsuit. But he stopped short of immediately ordering the Justice Department to track them all down.

U.S. District Judge Dana Sabraw in California said the universe of separated families should extend beyond the 2,700-plus children taken from their parents last spring, and include families forced apart as early as July 1, 2017, and the months afterward, when the Trump administration was denying that it had a policy of separating families.

Sabraw said a government watchdog report in January that potentially thousands more families were separated than the Trump administration had admitted publicly compelled the court to look into the matter.

“The hallmark of a civilized society is measured by how it treats its people and those within its borders,” he wrote in a 14-page ruling. “That Defendants may have to change course and undertake additional effort to address these issues does not render modification of the class definition unfair; it only serves to underscore the unquestionable importance of the effort and why it is necessary (and worthwhile).”

The ruling dramatically expands the scope of the class-action lawsuit that compelled the Trump administration to reunite the separated families and prolongs a political fiasco for the president that had been nearing its end.

Sabraw said he would hear arguments later this month to decide whether to require the Trump administration to locate the rest of the families. But he said “the Court has an obligation to resolve that question,” especially for parents who may have been deported without their children, and although it “may be burdensome, it clearly can be done.”

Otherwise, he wrote, parents may have been deported without their children, creating the “very real possibility of a permanently orphaned child” because of the “questionable” actions of government officials.

The Justice Department did not immediately respond to the ruling.

The American Civil Liberties Union, which represents the parents in the lawsuit, cheered the decision and said it would ask Sabraw to order the Trump administration to provide the names and contact information of all the separated families, as they did for the ones split up last spring.

“The court powerfully stated that there’s a lot at stake here and that it was not prepared to let the government escape responsibility simply because it might be burdensome to track the families down,” said Lee Gelernt, lead attorney in the family separation lawsuit and deputy director of the ACLU’s Immigrants’ Rights Project.

More than 2,700 migrant children were separated from their parents from May 5 to June 20 in a controversial attempt to deter rising numbers of illegal border crossings, particularly of families, most of whom were released in the United States because of what the Trump administration called legal “loopholes.”

Homeland Security Secretary Kirstjen Nielsen and then-Attorney General Jeff Sessions opted to criminally prosecute all adults who crossed the border illegally, even if they were with children. Adults were detained, and their children were shuttled to shelters across the country.

Trump rescinded the crackdown on June 20 amid widespread protests, including from Republicans, that the separations were harming children.

Days later, Sabraw ordered the administration to put the families back together, which required combing through handwritten and electronic files to find children as young as babies and nearly 500 parents who had been deported without them.

Almost all the families had been reunited when the Inspector General for the Department of Health and Human Services issued the report in January that surprised Sabraw and the ACLU. The report estimated that “thousands” of other children may have been taken from their parents, including from July 1, 2017, to November 2017, during a trial run of the crackdown in West Texas and New Mexico. Until then, the ACLU had heard of only a few such cases.

At a hearing last month, Justice Department lawyers said most of those children were probably with a parent or a close relative who had been vetted by the government, and expressed concern that contacting the families could traumatize the children. They suggested having parents file individual lawsuits to get their children back.

Sabraw, a Republican appointee in the Southern District of California, said in his ruling that such a requirement would make it “virtually impossible” for deported parents to get their children back.

The ACLU has noted that many parents hail from remote villages in Guatemala and other Central American nations and would face severe difficulties in finding their children.

In his ruling, Sabraw noted that lawmakers and government inspectors have been looking into the family separations, but he said that did not diminish the court’s obligations in the case.

“Clearly,” the judge wrote, “the matter of determining the ‘number and status of separated children’ who have entered (government) care at any point in time because of the Administration’s family separation policy is not going away.”

The lawsuit is Ms. L v. U.S. Immigration and Customs Enforcement in U.S. District Court for the Southern District of California.

ICE Agents Forged Signatures, Skipped Review to Keep Migrants Detained: Report

A CNN investigation into the contested firing of an Immigration and Customs Enforcement deportation officer turned up evidence of forgery and cut corners on arrest and deportation warrants. Brent Oxley in Little Rock, Arkansas, was fired last May for forging his supervisor’s signature on arrest warrants for undocumented immigrants and other charges. He contested his dismissal, insisting he was not alone in cutting corners when it came to arresting and deporting undocumented migrants. CNN reports it discovered that many agents were given pre-signed warrants and that a number of officers skipped the review process mandated by U.S. law to begin the deportation process. “There’s zero review,” one officer told CNN. “They trust me and everybody on my team. They don’t review any of it. [The warrants] are only reviewed when [the detainees] are already in our custody and we place the files in front of them.” ICE spokesman Vincent Picard told CNN the agency was “not aware of any widespread confusion or instances of improperly issued warrants.”

The US now has more than 15,000 of these kids in custody and are deliberately trying to keep them locked up in violation of US laws for as long as they can. They are threatening to deport anyone they can find in connection with would be sponsors and family members.

So eventually many if not most of these kids are going to end up in the same foster care system shootersa tries to use as a false flag to cover up what Trump and his administration are doing.

And Ironically once these kids get stuck in foster care they are held until they are 18 and then can become US citizens.

Family Separation
By the Numbers

Last February, the ACLU sued the Trump administration in federal court, challenging its illegal and cruel practice of separating the children of asylum-seekers and border-crossers from their parents. The events that followed shocked the world, as thousands of minors were locked away in immigration facilities alone while their parents were detained far away. On June 26, U.S. District Court Judge Dana Sabraw issued a preliminary injunction that ordered the government to return all children under five years old to their parents within 14 days and within 30 days for the rest.

The government has since provided the court with data that indicates at least 2,654 immigrant children were separated from their parents or caregivers as a result of Trump administration policies. Further data was provided to the ACLU about the age and gender of those children, their country of origin, and how long those still in the custody of the Office of Refugee Resettlement (ORR) have been held. The ACLU is making this data available here to help illuminate the details of this devastating policy. For hundreds of these children, the nightmare isn’t over yet.

While we believe this data provides a valuable window into the family separation crisis, we also have some concerns about how comprehensive and accurate it is. On Oct. 2, the Department of Homeland Security’s inspector general released a report which stated that “DHS struggled to provide accurate, complete, reliable data on family separations.” The eventual reunification of these children and parents was, by all accounts, not a priority of those who designed and carried out the policy. The ACLU has not undertaken an independent data investigation, and instead has had to rely on the numbers provided to us by the government. Thus, this data may well undercount the number of children who were separated or contain other gaps.

How many children are still in ORR care? (all numbers as of 10/15)
According to the government’s status report to the court on Oct. 15, there were 2,654 children initially determined to have been possibly separated from their parents. Of that number, 2,363 have been discharged from ORR custody, and the government says that 46 turned out not to have been accompanied by a parent when they crossed the border. Another 125 children have made the difficult decision — in consultation with their parents, who have already been deported — to remain separated in order to stay in the country and pursue asylum. These 125 are thus not seeking reunification with their parents at this time. Their main pathway to release at this point is to live with other family or sponsors here in the U.S.

This leaves 120 children who were separated from their parents, were in ORR care as of Oct. 15, and who have not decided to waive reunification. We believe that every separated child and parent who want to be reunified should be reunified.

These 120 children fall into two groups: 50 with parents who were removed from the U.S. by the government and 70 whose parents are still in the U.S.

The ACLU and a Steering Committee composed of the law firm of Paul, Weiss, Justice in Motion, Kids in Need of Defense (KIND), and the Women’s Refugee Commission have been working to locate the deported parents of children still in ORR care, document decisions about reunifying, and make sure the families are making an informed choice.

Of the 50 children with parents outside the U.S. who have not waived reunification, about 20 are waiting to be sent back to their country of origin to be reunified with their parents. Around 15 of them have parents who haven’t yet signed and submitted the forms required for reunification; approximately ten are still in discussion with their children and counsel about their options, and five have parents who haven’t yet been reached.

About 70 children in ORR care have parents who are still in this country. (The categories noted below do not add up exactly to 70 because of problems with the data that the government released to the public and the ACLU.)

Many of these families could be reunited if not for the government’s opposition to reunifying them, along with other delays the government has not yet explained. In the case of 13 of these children, the government has not identified a reason why they have not yet been reunited with their parents. One of the 70 has a parent who is in the custody of government agencies other than ICE. Once this parent is transferred back to ICE custody, they may then be able to be reunited with their children. Two more children are not reunified because of “red flags” for an ongoing safety review.

Stop Separating Families: Sign the Petition

Twenty-six of those 70 children have parents whom the government have said are disqualified from being reunited with their children because they have been labeled “unfit or present a danger to the child.” These parents have been placed into this category and prevented from being reunited with their children on the basis of past allegations or convictions. The ACLU is concerned about this category given its inclusion of parents who have no criminal convictions outside of their prosecution for immigration violations, as well as those with other criminal histories that should not result in losing custody of their children.

Twenty-seven more of the 70 children have parents inside the U.S. who signed paperwork while in custody indicating they would allow their child to leave ORR care to live with a sponsor. The government considers these parents to have “indicated an intent not to reunify,” and their children are still in ORR care, having neither been reunited with their parents nor released to a sponsor.

How long have they been separated from their parents?
For the children still in ORR care awaiting reunification, the median length of detention so far is 154 days — more than five months. Some have been in detention as long as a year. For example, one four-year-old child, “Luna,” was separated from her father for nearly 10 months before they were reunified in Guatemala on Sept. 28. This figure excludes separations where the child and the parent have decided to waive their right to reunification.

What was their age and gender?
Of the initial pool of 2,654 separated children, the majority was male (64.5 percent). 1,033 of them were under the age of ten when they were detained, including 103 under five. The data furnished by the government shows a sharp drop off in the number of separated children between five and four years old.

Where were they held?
Separated children were sent to 121 different detention or care centers in 17 states throughout the country, often hundreds or thousands of miles away from where their parents were held. The largest network of child detention centers are the Southwest Key facilities in Arizona, California, and Texas, where 1,091 (41 percent) of the children were detained. While the majority of these children have since been returned to their parents, for security reasons we are not providing the name or location of these facilities.

Where were they from?
Because children under five were generally — although not always — expedited for reunion with their parents, the data on their cases is less complete than for the pool of older children. Thus, country of origin data below is limited to children between 5-17 years old. Of that group, 1,423 (55.8 percent) were from Guatemala, with another 848 (33.2 percent) from Honduras. Much smaller numbers of separated children were from El Salvador (179), Brazil (43), Mexico (30), Romania (12), and elsewhere.

The Trump administration is imposing new limits on the detention of migrant families at the Mexico border in order to prevent overcrowding at facilities, The Wall Street Journal reports. As of this week, hundreds of families picked up each day in Texas’ Rio Grande Valley are reportedly being released by Border Patrol agents—in the past they would have been handed over to U.S. Immigration and Customs Enforcement and potentially detained for longer periods of time. The exact number of families being released will depend on how much room there is at ICE detention facilities, many of which are at capacity. Government officials told the Journal that the changes are being implemented because of crowding and safety concerns. President Trump repeatedly pledged to end what he called “catch-and-release” at the border in favor of “catch-and-detain,” but immigration officials have struggled to find room as facilities have filled up. Government projections suggest a record volume of families have attempted to cross the border.

Federal Migrant Center in Florida Investigated for Six Cases of Alleged Child Sexual Abuse

Florida’s child-welfare agency has investigated six cases of alleged child sexual abuse at a federal migrant shelter in South Florida in less than a year, the Sun-Sentinel reports. The cases include allegations against caregivers looking after migrant children. The shelter in question, Homestead temporary migrant children’s shelter, was reopened by the federal government last March as part of Trump’s “zero-tolerance” policy. Since then, the Florida Department of Children and Families has investigated six sexual-abuse claims at the facility. Investigators later said there were no “indicators” of abuse, but some lawmakers remain concerned. “Knowing what we know about children in vulnerable situations, the only conclusion we can make is that this is the tip of the iceberg because we know there’s under-reporting,” said state Sen. Jose Javier Rodriguez.

The U.S. Department of Health and Human Services, which oversees the contractor that runs Homestead, said any allegations of sexual abuse involving federal staff results in immediate removal from duties that give the staff members access to children. The federal agency declined to comment to the Sentinel on the six cases reported at Homestead.

Here's the thing. The child separation policy is just hands down the worst thing I have seen the US government do. And they did it with no plan, We literally created orphans. And for what. It was mostly based on racism. The situations driving asylum seekers have gotten worse. And we are actually right back to catch and release. And that ought to be bad enough. But nothing is ever bad enough for Trump. Might as well throw lying about a child's death in there as well.

AP FACT CHECK: Trump Twists Facts Of A Migrant Girl’s Death

WASHINGTON (AP) — President Donald Trump is misrepresenting the circumstances of a 7-year-old migrant girl’s death as he seeks to steer any potential blame for it away from his administration.

Trump, after mockingly painting asylum seekers as a “con job” in a rally the previous night, asserted on Friday that Jakelin Caal Maquin was given no water by her father during their trek to a remote border area and that the dad acknowledged blame for his daughter’s death on Dec. 8. Those assertions are not supported by the record.

TRUMP: “I think that it’s been very well stated that we’ve done a fantastic job. … The father gave the child no water for a long period of time – he actually admitted blame.” — to reporters Friday.

THE FACTS: An autopsy report released Friday found that Guatemalan girl died of a bacterial infection just more than a day after being apprehended by the U.S. Border Patrol. The El Paso County Medical Examiner’s office said traces of streptococcus bacteria were found in Jakelin’s lungs, adrenal gland, liver, and spleen, and she experienced a “rapidly progressive infection” that led to the failure of multiple organs.

Neither the autopsy report, nor accounts at the time by Customs and Border Protection, spoke of dehydration. And through family lawyers, Nery Gilberto Caal Cuz said after his girl’s death that he made sure she had food and water as they traveled through Mexico.

Moreover, the Border Protection timeline on her case said she was checked for medical problems upon her apprehension and: “The initial screening revealed no evidence of health issues.”

The girl and her father were caught at 9:15 p.m. on Dec. 6 in a group of more than 100 people trying to cross the border, less than a mile or kilometer from the Antelope Wells entry port in New Mexico. The father claimed upon their apprehension that she was in good health. In any event, no health problems were observed.

Her first distress was reported at 5 a.m. the next day, when her father said she was vomiting on a bus waiting to take them to a Border Patrol station at Lordsburg, New Mexico. When the bus arrived close to 6:30 a.m., the father said Jakelin was not breathing. A Border Patrol emergency technician revived her twice. She had a temperature of 105.7 degrees. At 7:45 a.m., a helicopter flew her to the nearest trauma center, in El Paso, Texas, where she went into cardiac arrest late that morning and was revived once more.

By then breathing by machine, with brain swelling and liver failure, she died on Dec. 8 at 12:35 a.m., her father with her.

Afterward, Trump insisted in tweets that the girl and another Guatemalan child who died in custody, Felipe Gomez Alonzo , were “were very sick before they were given over to Border Patrol.”

But the boy also did not arouse any concern in initial screenings. He was in U.S. custody for five days before suddenly falling ill.

In his Michigan rally Thursday night, Trump entertained his supporters with an apocryphal story of a “heavyweight champion of the world” pleading a hardship case while seeking asylum. “It’s a big fat con job, folks. It’s a big fat con job.”

He said “you have people coming up here” who are coached by lawyers to “say the following phrase: ‘I am very afraid for my life. I am afraid for my life.’ OK.”

On Friday, he said of the children’s deaths when asked about them: “It’s a horrible situation. But Mexico could stop it.”
